Washington County Probate — What to Expect

When a loved one passes away and owned assets in Washington County, the estate administration process runs through the Register of Wills and the Orphans' Court Division at the Washington County Courthouse, 1 South Main Street, Washington, PA 15301. This office handles the qualification of executors and administrators, acceptance of inventories, and oversight of formal accountings when required.

Probate in Pennsylvania follows a defined process: the executor is qualified, creditors are notified, assets are gathered, taxes are paid, and distributions are made. Some estates resolve in a few months. Others, involving real property sales, contested claims, or complex tax elections, take longer. What matters is having an attorney who manages each step systematically, communicates clearly, and provides transparent pricing from the start.

The Probate Process in Washington County

1

Strategy & Intake

We review the will, identify all assets and debts, assess liquidity for tax obligations, and develop a clear administration plan. You know the scope and the fee before any work begins.

2

Open the Estate

We file the petition with the Washington County Register of Wills to qualify the executor or administrator. We prepare all required filings and attend any hearings with you at the courthouse in Washington.

3

Notices & Inventory

Pennsylvania law requires publication of notice to creditors and formal notice to heirs. We handle publication in Washington County-approved newspapers, prepare the Inventory, and manage creditor claims during the statutory claims period.

4

Pennsylvania Inheritance Tax

Pennsylvania imposes inheritance tax on most estate assets. Rates depend on the beneficiary's relationship to the decedent. We prepare the REV-1500 return, coordinate with your accountant if needed, and advise on the 5% early-payment discount available when the tax is paid within three months of death.

5

Account, Waivers & Distribution

We prepare the informal family settlement agreement or coordinate a formal audit if required, obtain beneficiary consents, and guide final asset distributions. We close the estate with the Register of Wills once all obligations are satisfied.

Do You Need Probate?

Not every asset requires probate. Assets that pass automatically, such as joint accounts with survivorship rights, accounts with named beneficiaries (POD/TOD, IRAs, 401(k)s), and assets in a funded revocable trust, generally do not go through the probate process.

Assets titled solely in the decedent's name, including Washington County real estate, typically do require probate. If the deceased owned a home in Canonsburg, McMurray, Peters Township, or anywhere else in the county, that property will need to pass through the estate before it can be transferred or sold. We evaluate the full picture during your initial consultation and advise on the most efficient path forward.

Pennsylvania Inheritance Tax Rates

Pennsylvania's inheritance tax is assessed against most assets that transfer at death, including real estate, bank accounts, investments, and personal property. Current rates:

Beneficiary Tax Rate
Surviving spouse 0%
Children, grandchildren, parents 4.5%
Siblings 12%
All other individuals 15%

The tax is due within nine months of the date of death. Paying within three months earns a 5% discount on the amount paid, a meaningful savings on larger estates.

Small Estate Options

Pennsylvania provides streamlined options for modest estates, including the ability to use a small estate affidavit to transfer certain assets without full probate administration. Whether a simplified path is available depends on the nature and value of the estate assets. We assess eligibility during your consultation and prepare the appropriate filings if a streamlined procedure applies.

Remote Probate — Handle Everything Without Coming to the Office

You do not need to come to our office or travel to the Washington County courthouse to probate an estate. We handle probate matters across Western Pennsylvania entirely remotely when needed — phone consultations, e-signature platforms for all documents, electronic filing where the court permits, and coordination with the Register of Wills on your behalf.

This is especially important for:

  • Out-of-state executors. Pennsylvania permits out-of-state executors with a Pennsylvania resident co-executor or surety bond. We handle all local filings and court appearances so you never need to travel to Washington County.
  • Families spread across the country. When siblings and beneficiaries live in different states, we coordinate everything by phone, email, and e-signature — no one needs to take time off work to sit in our conference room.
  • Busy professionals. If your schedule does not allow in-person meetings, we accommodate entirely virtual engagements from intake through final distribution.

Every Washington County probate matter we handle can be done without a single in-person visit. We have been doing this for years — it is not a workaround, it is how we practice.
